1. Introduction

1.1. The Malta Model United Nations Society (VO/0800) (“MaltMUN Society”, “MaltMUN”, “Society”, “We”, “Us”, “Our”, “It” or “Its”) provides a Service for young persons to participate in a Model UN conference through Its Website, www.maltmun.org.mt, which is accessible here (the “Website” or “Site”). By means of the Site, the user is directed to the application forms to participate in its annual Conference, foreign Model UNs as well as other events by the Society (collectively, the “Services”).

1.2. Please note that Your explicit consent to Our Privacy Policy, and the practices described therein, is required to be able to avail Yourself of the Services. This consent will be prompted upon Your access to the Website through a banner at the top of the Website asking You to ‘Accept and close’ the prompt if You agree to the Policy and if You apply to any of Our events.

1.3. These Terms effectively govern any use You make of the Services. Therefore, specifically, applications to the MaltMUN 2018 Conference and other events hosted by the Society shall be regulated by these Terms.

1.4. Furthermore, these Terms also explain the conditions applicable for registering and participating in the MaltMUN 2018 Conference.

1.5. By using Our Website or otherwise availing Yourself of any of Our Services, You are hereby agreeing to be legally bound with immediate effect by these Terms. Such acceptance shall also be deemed to extend to all of Our other polices (if any) which have been incorporated by reference into these Terms (with the exception of Our Privacy Policy, which must be consented to separately).

1.6. Should You not wish to be bound by these, please leave this Website immediately and do not use Our Services.

1.7. No part of this Website may be reproduced in any form by any means or stored in an information retrieval system without the permission in writing of the MaltMUN Society.

2. Voluntary Organisation Status

2.1 For identity purposes, the Malta Model United Nations Society Association is a Registered Voluntary Organisation in the Republic of Malta with VO/0800.

3. Definitions

Delegate A delegate is someone who has successfully applied to attend a MaltMUN Conference.
Registrant A registrant is someone who has registered to attend Our annual Conference. People can register online solely through the MaltMUN Website. Registration is considered successful once all fields are filled in and after payment of the delegate fee is effected.
Malta Model United Nations Society           A Maltese registered voluntary organisation (VO/0800). These Terms and Conditions may refer to Our organisation as ‘MaltMUN’, ‘Society’, ‘Model UN’, ‘Conferences’, ‘Our’, ‘Us’, or ‘We’.
Staff Includes a person who has applied to staff Our annual Conference. These include Chairing, Press and Secretariat members.
Service Service refers to the MaltMUN Website (https://maltmun.org.mt) and other content operated by MaltMUN.
User A User is any living individual who is using Our Service and is the subject of Personal Data. This term may also be used interchangeably collectively to refer to a visitor, newsletter subscriber, registrant, applicant or business partner.

These Terms and Conditions will refer to a User as ‘You’ or ‘Your’.

4. General

4.1 These are the Terms and Conditions applicable to all Services offered by the MaltMUN Society.

4.2. MaltMUN offers Services to young persons, being:

4.2.1 Persons who are between the ages of 16 to 35 years old.

  • Therefore, natural persons need not be of full age; that is eighteen (18) years of age or higher, depending on the person’s domicile, residence or jurisdiction.
  • While persons below the age of 18 are allowed to participate in the Conference, they are expressly excluded from entering the Conference social venues.

4.3. No one shall have an inherent or vested right to participate and become a member of MaltMUN. The acceptance of such participation and membership is at the discretion of MaltMUN.

4.4. Users of the Website are required to keep their information accurate and up-to-date, and to update such information accordingly when relevant changes occur.

5. Feedback and Review

5.1. Your feedback and review of the Services that MaltMUN provides, as well as the manner and each in applying to these Services can help Us improve the quality of these Services.

6. Registration and Payments

6.1. Our Website features two forms of applications to MaltMUN 2018.

6.2. Persons can register either as individuals or as a delegation of multiple participants.

6.3. Registration via the Website is automated, and registrants should receive acknowledgement of their application and receipt of payment only upon submitting the application and making such payment.

6.4. Delegations of multiple participants should submit their details through one application and pay the fee through the same application. Upon submitting the application, the head delegate will receive acknowledgment of receipt of payment.

6.6. All fees have to be paid to MaltMUN via PayPal after clicking ‘Submit’ on the delegate application.

6.7. The conference fees are indicated in Euro (EUR) per delegate on the relevant applications. There are two social events on Friday night and Saturday night. Social packs are not included in the conference fee and are instead given as an option for the delegate to choose within the application form.

6.8. A registrant who starts an application but fails to make payment by clicking ‘Submit’ at the end of the application which will open up Paypal will not be considered as having applied at all.

6.9. Failure to make payment will result in the application’s status registering as ‘pending’ which will not be considered as a successful application.

6.10. It is at MaltMUN’s discretion whether to re-activate an application which has been left ‘pending’.

6.11. In extraordinary circumstances, the Society may allow payment of fees by bank transfer.

6.12. MaltMUN will not cover bank charges of any kind.

6.13. The Society’s decision is final.

6.14. All registrations are done on a first come, first serve basis. Due to limited availability at Our conference facilities, once We reach the threshold, applications will no longer be accepted. If in the period of reaching the threshold and its closure an application is submitted, the registrant will be refunded.

6.15. At the stage of pressing ‘Submit’, You will be directed to the Website of the third party service provider which We use to process payments, and You shall be required to supply Your billing information.

6.17. You hereby agree to hold the MaltMUN Society harmless to the maximum extent permitted by applicable law for any damages or other losses that may result from the disclosure or release of Your personal information by any of these third-party service providers.

7. Right of Withdrawal

7.1. If you constitute a “consumer at law and reside in the European Union, You are entitled to a fourteen (14) day “cooling-off period” or a “right of withdrawal”, during which You may withdraw from Your application for any reason and be refunded. Generally, You are deemed to be a “consumer” if You are neither a business, nor an individual who makes use of the Services offered by MaltMUN for purposes that are wholly or mainly concerned with any business.

7.2. Please note that the refund will be effected through Paypal.

8. Privacy

8.1. MaltMUN reserves the right to use all data submitted by individuals via Our Website, sent to the MaltMUN Society by other ways, and collected during the conference and social events including video footage and photographs, subject to the limitations in our Privacy Policy. MaltMUN reserves the right to collect data during the conference and social events including but not limited to personal data, video footage, and photographs without further notice.

9. Web Disclaimer

9.1. All information is provided by the MaltMUN Society. While We try to keep the information up-to-date and correct, We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Website or the information, products, services, or related graphics contained on the Website for any purpose. Any reliance You place on such information is therefore strictly at Your own risk.

9.2. In no event will We be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this Website.

9.3. Through this Website, You are able to link to other websites which are not under the control of MaltMUN. We have no control over the nature, content and availability of those websites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

9.4. Every effort is made to keep the Website up and running smoothly. However, MaltMUN takes no responsibility for, and will not be liable for, the Website being temporarily unavailable due to technical issues.

10. Intellectual Property Rights

10.1 MaltMUN claims copyright on all of the data available on the Website, including but not limited to the MaltMUN logo, format and screen design of the Website, on all other data related to and released by MaltMUN and on all contents created during or for MaltMUN or those that are submitted to MaltMUN. The MaltMUN Society claims copyright on all of its printed material. Some images on the Website and printed material are used under license and may not be stored or reproduced without the consent of the copyright holder. All rights are reserved. No part of this website may be reproduced in any form by any means or stored in an information retrieval system without the permission in writing of MaltMUN.

10.2 All other texts, graphics, editorial content, logos, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and all other content or material found on the Website not claimed by MaltMUN is subject to third party protection. You acknowledge that the availability of this material not claimed by MaltMUN does not authorise You to make use of such material Yourself in a manner which would be in breach of third-party intellectual property rights.

10.3 Your failure to abide by this will expose You to damages, and in the case of a breach of any third-party rights, You agree to defend, indemnify and hold Us harmless against all claims, actions or suits which may be brought in connection with this breach.

11. Liability

11.1. Participants are expected and obliged to obey the laws of the Republic of Malta while participating in the events of MaltMUN.

11.2. Participants are personally responsible for all charges and damages to facilities of the conference and social events venues.

11.3. MaltMUN does not provide liability insurance for the protection of individuals or groups who participate in the conference.

11.4. Each individual and delegation agreeing to these Terms and Conditions releases and discharges MaltMUN, its Secretariat, and Staff jointly and severally from any and all actions, causes of actions, claims, liabilities, costs, obligations and demands, including without limitation attorneys’ fees and expenses for, upon or by reason of loss, damage, injury, or death, which hereafter may be sustained by participating in any activities connected with MaltMUN. This involves especially compensation, in part or in whole, for losses, damages, injuries or death incurred at or in connection with MaltMUN.

11.5. MaltMUN will not offer any services to minors without an express release of liability signed by a parent or legal guardian. No refunds will be made to minors who fail to demonstrate a signed accident waiver by a parent or legal guardian upon registration at the conference facilities.

11.6. Only delegates who are over 18 years of age will be allowed to purchase Social Packs. Anyone who is under the age of 18 and purchases a social pack will be refunded the social pack fee and will be denied entry to the social events. ID cards or other appropriate official documentation must be presented at the entrance of Our venues.

12. Termination and Right to Exclude

12.1 MaltMUN reserves the right to exclude specific individuals or groups of individuals from its offered Services. MaltMUN excludes any legal actions on the side of the individual or group of individuals related to a possible exclusion. No exclusions shall be made on grounds including but not limited to gender identity, race, sexual orientation, religion or national origin.

12.2 MaltMUN may, without prior notice, terminate Your application and suspend or permanently block Your access to the Website at any time for any valid reason, including due to any improper use of the Website or failure to comply with these Terms or other terms which have been incorporated herein by reference.

13. Notice

13.1. Any notice or other communication to be given by Us in connection with these Terms shall be by electronic mail through info@maltmun.org.mt

14. Indemnity

14.1. You agree to fully release MaltMUN from any claims which third parties might assert against MaltMUN due to an infringement of their rights, or a breach of duty or a breach of a contractual obligation You may have been liable to. Reasonable costs of a legal defence (in particular, attorney fees) which MaltMUN has demonstrably incurred through Your misconduct, must also be reimbursed in full.

15. Miscellaneous Provisions

15.1. We do not insist immediately that You do anything You are required to do under these Terms. If We delay in taking steps against You in respect of Your breach of these Terms, that will not mean that You do not have to do those things and it will not prevent Us from taking steps against You at a later date.

15.2. We reserve the right to make changes to these Terms from time to time. We shall notify You with the updated Terms and shall also post these updates on Our Website. Unless You communicate otherwise within one (1) week of Your receipt of these updated Terms or upon Us posting these updates on Our Website (whichever is earlier), You will be assumed to have accepted and consented to the updated Terms in full.

16. Applicable Law and Jurisdiction

16.1. The legal relationship between the parties to these Terms is subject exclusively to the Laws of Malta.

16.2. For all disputes which may arise between You and MaltMUN in relation to these Terms or as generally arising from the use of the Services offered by MaltMUN, the parties will make all amicable attempts to resolve the dispute in the least onerous manner and without the need of instituting judicial proceedings (of whatever form or nature). However, if the dispute cannot be resolved, the parties agree that the Courts of Malta shall have exclusive jurisdiction to hear and determine the dispute.

16.3. Proceedings regarding disputes must be commenced in a court of competent jurisdiction in Malta within six (6) months after the dispute arose. Any shorter time limit provided by statute or other law remains unaffected.

17. Validity of Terms

17.1. If any court or other authority finds any clause or provision in these Terms, or part thereof, to be illegal, the rest of the Terms, including the unaffected part of the clause or provision concerned, will continue to apply in full force and effect.
